Block 64 Corporation (the “Company”) respects its Customers’ privacy and is committed to protecting it by complying with this policy (the “Policy”).
The Policy describes:
The types of information the Company may collect or that our customers (the “Customer“) may provide when it uses Company software and services (the “Software and Services“).
The Company’s practices for collecting, using, maintaining, protecting, and disclosing that information.
The Company will only use the Customer’s information in accordance with the Policy unless otherwise required by applicable law. The Company will take steps to ensure that the information it collects about the Customer is adequate, relevant, not excessive, and used for the purpose intended.
The Policy defines “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. The Policy applies to all information the Company collects.
Information the company collects about the customer and how information is collected
The Company collects information about the Customer through:
Direct interactions with the Customer when it provides information to the Company, for example, by filling in forms, questionnaires or corresponding with the Company by email, phone and video conference.
Automated technologies or interactions, when the Customer uses the Software and Services, for example, software installation and usage details, IT hardware installation and usage details and other information about the Customer’s network connected IT assets, collected through our proprietary software.
The types of information the Company collects include:
Personal information that the Company can reasonably use to identify the Customer directly or indirectly, such as:
- The Customer’s name and email address.
- The Customer’s domain and username.
(b) Non-personal information or information that does not directly or indirectly reveal an individual’s identity or directly relate to an identified individual including:
Software and Application Information. What software (and versions) are installed; how the software is configured; when the software was installed; who has access to the software; how the software is performing; frequency of software application use; what features and modules are turned on or off in software applications; device personalization and preference settings; and application usage patterns;
Demographic information, or statistical or aggregated information. The Company may derive non-personal statistical or aggregated data from personal information. For example, the Company may aggregate personal information to calculate the percentage of users accessing a software application feature;
Technical Information. The device types you operate, time zone setting, and hardware or data storage details recorded at the operating system level of endpoint devices;
Usage details. Details of the Customer’s access to and use of software including location data, logs, and other communication data; including software dependencies and network traversal patterns; and
Hardware and Device information. The Company may collect information about the Customer’s hardware and internet connection, including the device’s unique device identifier, IP address, operating system, browser type and network information
The Company may maintain the Non-personal information it collects or associate it with personal information that the Customer provides.
How the company uses customer information
The Company uses the Information it collects about the Customer to provide the Company’s Software and Services including:
- IT asset management;
- Cloud enablement and migration;
- Server optimization;
- Improve cyber and data security;
- Software compliance analysis;
- Software support and renewal management;
- To fulfill any other purposes for which the Customer provided it or that the Company described when the information was collected;
- To carry out the Company’s obligations and enforce its rights in any contracts with the Customer, including for billing and collection or to comply with legal requirements;
- To improve the Software and Services, or Customer relationships and experiences
- To measure or understand the effectiveness of the Software and Services the Company provides to the Customer and others;
- For any other purpose with the Customer’s consent.
- Usage information that the Company collects helps it to improve the Software and Services and to deliver a better and more customized experience, including by enabling it to:
- Estimate usage patterns.
- Store information about the Customer’s preferences, allowing it to customize the Software and Services according to the Customer’s needs.
- Improve software performance usability.
- Identify new feature requirements.
Disclosure of the customer’s information
The Company may disclose the Customer’s information to third parties for the following reasons:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request, according to applicable law.
- To enforce the Company’s rights arising from any contracts between the Company and the Customer, and for billing and collection.
- If the Company believes disclosure is necessary or appropriate to protect the rights, property, or safety of its customers, or others.
Disclosure of the customer’s information in Microsoft funded engagements
Where Microsoft Corporation, their subsidiaries, affiliates and/or Partners (“Microsoft”) are funding the Software and Services, the Company may disclose the Customer’s Non-personal information to Microsoft.
Microsoft may use the Non-personal information to contact the Customer about products and services that may be of interest to the Customer, as permitted by law, as well as to evaluate the Customer’s compliance with any applicable licensing agreements. If the Customer does not want the Company to use or disclose its information in this way, the Customer may choose to enter into a contract directly with the Company wherein the Customer may determine under what circumstances the Company may disclose its Information to third parties subject to the Company’s approval.
Transferring customer’s personal information
The Company transfers and stores Information it has collected from the Customer’s network to the Company’s data processing center by encrypted secure sockets layer (“SSL”) data link. As a result, the Company may transfer the Customer’s Information to other countries with different privacy laws than where the Customer is located. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to the Customer’s Information. The Customer may restrict the transfer of its Information from a designated Country by adjusting a setting on its local appliance. If the Customer would like to make use of this setting, please notify our Privacy Officer.
When a Customer provides its Information to the Company or engages with the Software and Services, the Customer consents to this transfer, storage, and processing of its Information.
Choices about how the company transfers customer information
The Customer may opt out of the transfer of its Information by adjusting a setting on its local appliance allowing the Customer to ensure that the Information is stored behind its own firewall. If the Customer would like to make use of this setting, please notify our Privacy Officer.
The security of the Customer’s Information is very important to the Company. The Company uses physical, electronic, and administrative measures designed to secure Customer Information from accidental loss and from unauthorized access, use, alteration, and disclosure. The Company stores all Information provided to it by the Customer behind firewalls on the Company’s secure servers. For greater clarity, all credential or other personal information will be encrypted using data encryption technology prior to being stored.
Except as otherwise required by applicable law or regulation, the Company will only retain the Customer’s personal information for as long as is necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances, the Company may anonymize or aggregate the Customer’s personal information so that it can no longer be associated with the Customer. The Company reserves the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to the Customer with the Customer’s consent.
Accessing and correcting personal information
The Customer has the right to request access to and to correct the personal information that the Company holds about the Customer.
If the Customer wants to review, verify, correct, or withdraw consent to the use of its personal information the Customer may email our Privacy Officer to request access to, correct, or delete any personal information that it has provided to the Company.
The Company may request specific information from the Customer to help the Company confirm the Customer’s identity and its right to access, and to provide the Customer with the personal information the Company holds about the Customer in order to make any requested changes.
Withdrawing customer consent
Where the Customer has provided its consent to the collection, use, and transfer of its personal information, the Customer may have the legal right to withdraw its consent under certain circumstances. To withdraw consent, if applicable, contact our Privacy Officer. Please note that if the Customer withdraws consent the Company may not be able to provide the Customer with the Software and Services The Company will explain the impact to the Customer at the time to inform the Customer’s decision regarding consent.
Changes to the company’s policy
The Company includes the date the Policy was last revised at the top of the page. The Customer is responsible for ensuring the Company has its up-to-date, active, and deliverable email address, and for periodically visiting the Policy to check for any changes.
